GENERAL TERMS AND CONDITIONS
General terms and conditions and scope
Unless expressly agreed otherwise, these General Terms and Conditions apply to all transactions between the Schneesportschule Malbun AG (hereinafter referred to as SSSM) and its guests. The purpose of the company is to operate a snow sports school. This includes services such as giving lessons in the skills and knowledge of snow sports and outdoor activities, without guaranteeing a specific training success, as well as guiding and accompanying winter sports. The ski, snowboard and cross-country skiing instructors are hereinafter referred to as “snow sports instructors”.
Booking
By registering, the guest accepts the General Terms and Conditions as an integral part of the contract between him and SSSM. Registration is mandatory for all SSSM offerings. Bookings can be accepted in writing, by telephone, electronically or in person at SSSM or other points of sale that sell SSSM's offerings. Any wishes and concerns regarding eating habits, medical prophylaxis, etc. must be communicated to the snow sports instructor directly and in good time before the start of the activity (at least 24 hours in advance) so that he or she can take the necessary measures.
Rate
The prices given are in Swiss francs (CHF) and are calculated per person. When paying in euros (EUR) or other foreign currencies, the service provider's corresponding daily exchange rate will be applied. Unless otherwise stated in the detailed offer description, the price includes the cost of the lesson, course or tour. The prices therefore generally exclude personal meals, rental equipment and costs for transport to/from the mountain (mountain railways, taxis or public transport are therefore not included in the price). Any price changes remain reserved. The lesson prices are VAT-free.
Terms of payment
The total amount of the agreed service is due before the activity begins. If the course is not paid for before the start of the course, the snow sports instructor can refuse to start the lesson in consultation with the management. The Swiss franc (CHF) and the euro (EUR) are used as cash payment. When paying in euros (EUR) or other foreign currencies, the service provider's corresponding daily exchange rate will be applied. Change in cash will only be paid back in Swiss francs (CHF). We accept all common credit cards (MasterCard, American Express, Visa, Maestro, Postcard and Twint). A maximum of three reminders will be issued for unpaid invoices. Late payment interest of 5% (per year) and a reminder fee of CHF 20.00 per reminder will be charged for these reminders.
Credit card payment when booking online
Credit card payments for online bookings made in favor of SSSM are collected by M-SOFT SA, Lyron 10, 1978 Lens, Switzerland ("M-SOFT"). Payment is made through Virtual Terminal Saferpay (Worldwide). M-SOFT will appear on your credit card statement as M-SOFT or BOOKING-CORNER.COM LENS. The domain in which you enter and process your payment is owned and operated by M-SOFT. For all inquiries regarding credit card payments and chargebacks, the customer must contact info@booking-corner.com directly by email.
Cancellation or change of order by the customer
Reservations must be canceled no later than 24 hours before the start of the activity by telephone (+4232639770) or in writing by email (info@schneesportschule.li) or WhatsApp (+4232639770). The start of the activity always means the first day of the booked service. For cancellations up to 24 hours before the start of the course, you only must pay a processing fee of CHF 10.00. If the guest cancels later, the full tariff will be charged according to the booking. For short-term bookings within 24 hours, cancellation can no longer be accepted, and the full tariff must therefore be paid. Every lesson or group course started will be charged in full, even if the course must be ended early. If you must cancel your class, you can nominate a replacement guest. If a replacement guest enters the contract, you and he are jointly and severally liable for the payment of the entire lesson.
There is no right to a refund if:
-
the activity cannot be carried out due to late arrival or non-appearance of the guest.
-
the guest starts an activity after its scheduled start or leaves it before its end.
-
the guest does not take advantage of individual (half) days for multi-day bookings (including children's class lessons).
Cancellation or change of order in the event of illness or accident
In the event of illness or accident, part of the payment will only be refunded upon presentation of a medical certificate. This certificate must be issued on the day of the booked course or earlier. In such a case, the cancellation must be made in writing by email (info@schneesportschule.li) or WhatsApp (+4232639770) before the activity begins. For cancellations made up to 24 hours before the start of the course, processing costs of CHF 10.00 must be paid in the event of illness or accident. For cancellations due to illness or accident made after 24 hours before the start of the course, the cancellation costs amount to 50% of the course price for the corresponding day. If this is not reported and confirmed by us before the start of the course, the full price will be due. Cancellation due to illness or accident as well as receipt of the medical certificate must be confirmed by us, otherwise the cancellation is considered not received.
Cancellation or change of order by SSSM before the start of the activity
SSSM reserves the right to change or cancel the program or individual services at short notice after conclusion of the contract if natural and/or weather conditions or other unforeseeable circumstances (force majeure, official measures, security or other risks) require this. The refund will be in the form of a credit note.
Changing the program or canceling the activity after the start of the activity or within 24 hours
The SSSM reserves the right to change the activity program or individual agreed services if external circumstances (e.g. force majeure, weather and natural conditions, official measures or security risks) require it.
In the event of the following events, the guest will be refunded the payments made minus the expenses already incurred:
-
Closure of tourism service providers such as mountain railways, trains, hotels or restaurants due to official measures (e.g. pandemic).
There is no right to a refund for:
-
Closure of tourist service providers such as mountain railways, public transport (train, bus, etc.), hotels, restaurants and shops for rental equipment due to weather or natural conditions (e.g. official storm warnings.)
-
Illness or accident (only partial) or other prevention of the guest.
General lessons
The SSSM recommends that all course participants wear a helmet. Wearing a helmet is mandatory for children under 18 years of age. Please note that the presence of parents can distract the children and thus disrupt the lesson. Also make sure that the children are dressed appropriately for the weather. As far as possible, the snow sports instructor speaks the same language as the children in their group.
Group lessons
Group course tickets are non-transferable and must be handed over physically (i.e. printed out) to the snow sports instructor. This course confirmation can be printed at home when making an online reservation or picked up at the ski school office. The snow sports instructor is expressly advised not to take children without a printed confirmation. Class lessons generally take place from five children per strength class and the maximum is 13 participants. If there are fewer children, the SSSM reserves the right to combine classes with different levels at short notice, shorten or cancel courses. For group courses, the snow sports instructor is not obliged to wait for participants who arrive late. You can take part in the weekly final group ski race if you have attended the course for 3 days or more.
Conditions of Participation
Good health is a prerequisite for all activities. The participant undertakes to inform SSSM of any health problems. The customer undertakes to strictly follow the instructions of the snow sports instructor. If a guest does not meet these conditions of participation or does not follow the instructions, SSSM reserves the right to exclude them from the activity. If an exclusion occurs, the customer is not entitled to a refund.
Liability
The SSSM expressly excludes any liability for accidents during lessons and competitions or any liability claims in connection with the SSSM's services. Any claims for damages due to errors in illustrations, prices and texts are expressly excluded.
Insurance
The insurance (health and accident insurance including sports accidents, etc.) is the responsibility of the guest. It is recommended that you take out cancellation cost and return transport insurance.
Complaints
Complaints or any damage suffered must be reported to the SSSM in writing by post or email (info@schneesportschule.li) no later than four weeks after the end of the activity. If a claim is asserted later, all claims will expire.
Data protection
SSSM reserves the right to use images of all services provided for marketing purposes. You can revoke your consent to the use and disclosure of data and images at any time by sending us a message to info@schneesportschule.li. The data necessary for business transactions will of course be treated confidentially.
Place of jurisdiction
The place of performance is the SSSM headquarters in Triesenberg. The exclusive place of jurisdiction is Vaduz. Liechtenstein law applies.
